I had a situation where the smell of alcohol was obvious. The person denied it. I could not in good conscience...let the person work, especially considering what the person was about ready to do.
So...it was a breathalyzer or leave work...they failed the breathalyzer and have not been back since. (by their own choice)
I guess the point is...situations are so dramatically different. Your brothers case is absurd...but I know that it is common, and I agree with you that in that situation his privacy was violated.
