Disposable People - March 2008 Attorney grumble...

Well we have yet to obtain any correspondence from our latest attorney. I had written a letter with a payment November 10, 2007 where I requested confirmation of the invoices and an explanation for additional payment when before the attorney left his firm we had a credit. Apparently some of the money remained with the original firm, it did not add up to the amounts described in the invoice from this attorneys new practice. The original firm is asking about the money in their account, something to do with the paper work. On January 02, 2008 we received an Invoice from the original firm identifying that they still had some of the money, I responded on January 05, 2008 to the original firm and the attorney, again requesting explanation.

My girlfriend calls up and the attorney says that he sent some paperwork. Okay, we did not receive it. When did he send it ? the response is that it is on his log. Okay send a copy, things do get lost in the mail. This banter has been going on for over a month. It is not in our best interests to delay, because our intent was to use him to address my girlfriends other outstanding issues. Get this crap over with.

This is a repeat of the Pre-Paid Legal Service attorney. Only after a year had passed and I contacted the Virginia State Bar did they claim that they sent a letter of referral, the date of the alleged letter was after the court date, but according to the Virginia State Bar they said they did their job. We never saw the letter of referral and not having an attorney cost my girlfriend a year. What was funny was that this service attorney asked whether we screened our calls, course we do because we went through a year of death threats, harassment, stalking and assaults - another attorney chose to ignore that.

If I was to take this to the Virginia State Bar they will say that the attorney has a record of sending the alleged letter so he must of sent it. The Bar will reply that we can hire another attorney to try to sue this attorney. This is not a solution and some of my money is sitting in a law firms account. Why cant these individuals respond professionally ? I sent the requirements in both my letters so that they could be addressed as his convenience, no letter, no communication with my girlfriend by phone. The question becomes whether this attorney represented my girlfriend competently on December 5, 2007 ? Another question is whether this attorney could be trusted to represent my girlfriend competently in the future ?

The other day I searched for a legal malpractice attorney and found one in Virginia Beach, Virginia, across the state. Just try to find legal malpractice attorneys in Virginia. Wonder if the Virginia State Bar excludes them as part of their policy change in 2000 ? This would further protect their members from action, nothing like telling a damaged client to sue and then there would not be any attorneys that would sue another member.

Kinda funny being in limbo land, trying to address some issues, hire a jerk, expect them to do their job. Then one notices that even after providing them with material they provide lackluster performance or non-performance. As a capitalist, opportunist one would expect that they would take advantage of assets to gain the greatest profit. It could be said that we do not have a case but then I have this.
