deja vu - all over again! Lawsuit seeks to seat Florida delegates

they've already done this -
and been rebuffed by the courts!

what's that definition of insanity, again?
oh, yeah...
it's doing the same thing over and over and expecting different results!

Lawsuit seeks to seat Florida delegates - South Florida Business Journal:

Three prominent Broward County Democrats filed a federal lawsuit Thursday morning against the Democratic National Committee, seeking to force the committee to seat Florida's delegates at the upcoming presidential nomination convention.

The DNC could not immediately be reached for comment.

The suit was filed by state Sen. Steven Geller, an attorney for Greenspoon Marder in Fort Lauderdale; Barbara Effman, president of the Democratic Club in Broward County; and Percy Johnson, a convention delegate.

The suit alleges that the committee failed to "treat equally all similarly situated states and Democratic voters" when it decided not to seat Florida delegates because the state moved up its primary date against party rules. The suit also claims the committee's actions violated "due process" because the sanctions against Florida "flow from a constitutionally inadequate process that implements DNC rules in an arbitrary manner."

Sen. Hillary Clinton, D-N.Y., won the Florida Democratic primary on Jan. 29 in a race where the candidates had agreed not to campaign here, but she now lags Sen. Barack Obama, D-Ill., in the delegate count. The state has 210 delegates.

i knew his name sounded familiar, and when i looked up his florida state senate page i realised where i'd seen him before...

democratic minority leader steven geller mocks the dnc over their sanctions:

interestingly enough, senator geller voted for the bill which moved their primary up against party rules, knowing full well the consequences of doing so...i fail to see why they couldn't have waited 7 more days to hold their primary like every other state who moved theirs up, that was a viable option and one they should have taken rather than this "no! me first! me first!" kindergarten bullshit they participated in...on top of all that, they had 30 days to come up with an alternative in order for their delegates to still be counted...incredible

it won't go anywhere.
SCOTUS rules " one man one vote" doesn't apply, as it's party primary, rather than election for office.

well, at least you have the knowledge of knowing your state representatives bamboozled your delegates right out from under you and are now using additional florida taxpayer money for a lawsuit we already know won't go anywhere...you must be so proud...tell me, do you plan on voting for the same old cast and crew that currently hold state office, or are you going to let them know what you think about their idiocy by voting them out of a job this fall?

I only get to vote for my district - so I can't throw them out.

I'm not gonna get into you about all the intracacies behind why Fla. Dems are pissed.
The reason it happened was because of the Omnibus Election reform bill that tied the primary date to it.
We were OK with losing some of the delegates - but not total disenfranchisement.

We're pissed at the DNC's idiotic mishandeling of the entire affair.
One ex. is the current poll #'s showing Hillary wiining, but Obama losing to McCain.
We're pretty much satisfied that Hillary is on our side, and Obama's Congressional delegation blocked any re-vote.

Should Fla's POPULAR vote count towards Clinton?
Not the delegates necessarily - but the vote was certified.

your state leaders had 30 days to propose an alternate plan to the dnc in order to "play by the rules"...they didn't feel the need, this has nothing to do with the dnc but rather the egos of your state electeds and their power trip...on top of that, it doesn't matter why they did it, they did it fully knowing the consequences of their actions...

depends, should the caucus votes count? and if not, why would you place more importance on florida's popular vote if you're not willing to include all of the votes other than even including florida, hillary still loses if all the votes are counted...

do they keep tabs of caucus votes?
is it 1 man 1 vote?
if the answer is yes, then yes they should be counted.

as to the dnc - they overplayed their card by total striping of the delegates.
I never could understand why NH, and IO are fist - they surely are not representational of America; but that's another story.
