Court Overturns Air Passenger Rights Law

NEW YORK (AP) — A federal appeals court has rejected a law requiring airlines to provide food, water, clean toilets and fresh air to passengers trapped in a plane delayed on the ground.

The 2nd U.S. Circuit Court of Appeals ruled Tuesday that New York's new state law interferes with federal law governing the price, route or service of an air carrier. It was the first law in the nation of its kind.

The appeals court said the new law was laudable but only the federal government has the authority to enact such a regulation.

The law was challenged before the appeals court by the Air Transport Association of America, the industry trade group representing leading U.S. airlines.

I'm not adverse to the idea of greater state's rights. Would have been nice if governors could have told bush to stick it up his ass when he called their national guard units up. ....... Yea, I know.

I think...a lot of our problems could be solved...if that were to happen...The part about greater states rights...actually governors telling bush to stick it up his ass would be not only beneficial...but actually quite entertaining.

But, a lot of our problems exist because either the federal government does not allow states to take actions that better represent their constituents, or they siphon the dollars away eliminating any chance for states to do their own work. It doesn't make sense for a government body so far away, so far detached from an area to make most of the decisions.

I actually thought that the idea of greater states rights would gain steam under Bush as people realized how badly a Texan could screw things up for the People of NY, MI Idaho or wherever...so far it really hasn't it

The reasoning behind this decision is somehow connected to the fact that in matters of aviation, the federal government controls all the airspace and virtually everything else about aviation.

When the states were formed, except for a few of the later ones, man could not fly. Imagine the regulatory nightmare if each state controlled its own airspace and aviation regulations.

I agree with what the law was meant to accomplish, but I understand the legal reasoning too.

This isn't regulation. It's the lack thereof. Reading the article I had a mental image of a slave-plane; people shackled to walls and deprived of vital necessities to life.

Look at how Louisiana loses all the revenues for offshore oil to the fed. Evr since the Whiskey Rebellion the fed has asserted dominance over the states. Especially when it came to matters of revenue enhancement.

Especially in education, and other affairs. And only for a declared war can guardsmen be called up. Would have dampened their little land grab.

No but the time has come for a serious readjustment of the federal government. Downsize some parts or eliminate them all together, and beef up others. Like food inspection, safetty inspections and the like.
